The state food for home consumption exemption is specific to individuals and then only on eligible items. 

If you believe that you were charged sales tax in error and the selling vendor has denied the sales tax refund, submit a request for a refund of sales tax on the form R-20127 along with all required supporting documentation; invoice and payment. 

Instacart is charging both state and local sales tax on grocery purchases. Louisiana statues state that sales tax is not to be collected on ‘food for further preparation at home’. In the examples above state sales tax should only be charged on the cooked rotisserie chicken. Thus they overcharged me $5.05 on 7/10 and $5.46 on 9/13.

When contacted by email Instacart support claims they are charging correctly and simply stops responding when presented with the facts shown above.


We decided to quit using Costco SameDay, but then COVID-19 happened. The following table shows the total overcharge incurred so far.

4.5% is the sales tax rate that one pays at the Costco warehouse for food in New Orleans.
